1. Agreement
These Terms apply to your use of theundeniableco.com (the “Site”), operated by The Undeniable Company LLC, an Arizona limited liability company (“The Undeniable Co.,” “we,” “us”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
2. Eligibility
The Site is not directed to children under 13.
3. What the Site offers
The Site shares information about The Undeniable Co., its Foundation → Calling → Action → Impact framework, and its content and resources. Some features, including the Foundation assessment and the Store, are not yet available.
Not professional advice. Content on the Site is for general informational and personal-growth purposes only. It is not medical, psychological, therapeutic, legal, financial or other professional advice, and it is not a substitute for guidance from a qualified professional.
Not an emergency service. The Site is not an emergency or crisis resource. If you or someone you know needs immediate support, call or text 988 in the US, or contact your local emergency number.
Not monitored. Assessment answers are not monitored for emergencies or signs of crisis. No one will contact you based on an answer. The assessment does not provide emergency response, and an automated result is a self-reflection aid, not a diagnosis or treatment plan. Do not use assessment answers or our support email to seek emergency assistance.
Planned assessment access. The Foundation assessment is not yet open. It will not require an email address. The current build saves answers and results on our servers through a browser-linked anonymous account. Returning depends on using the same browser and device and retaining its site data. Clearing site data or switching browsers or devices may make saved results inaccessible; it does not itself delete server-held information. There is no email-based recovery. We will publish the applicable retention, backup handling, and deletion process in the Privacy Policy before participation opens.
4. Store
The Store is not yet open. No orders or payments are accepted. Separate terms for purchases, shipping and returns will be published before sales begin.
5. Acceptable use
Don’t use the Site to break any law; interfere with or disrupt the Site or its security; scrape or copy the Site by automated means; attempt to access accounts, systems or data you are not authorized to access; or submit content that is unlawful, abusive or infringes someone else’s rights.
6. Intellectual property
The Undeniable Co. name, logos, the Foundation, Calling, Action, Impact and Upstream framework and its methodology, and all Site content and design are owned by The Undeniable Co. or its licensors and are protected by law. You may view and share Site content for personal, non-commercial purposes with attribution. Any other use requires our written permission.
7. Messages you send us
If you send us feedback or ideas, you agree we may use them to improve our work without any obligation to you. Our Privacy Policy explains how we handle personal information.
8. Links to other sites
The Site may link to third-party sites, such as social media platforms. We are not responsible for their content or practices.
9. Disclaimer of warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, The Undeniable Co. will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Changes
We may update these Terms as the Site and our products develop. We will post changes on this page and update the “Last updated” date. Continuing to use the Site after changes means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona.
